Yorkshire disciplinary panel
« on: April 21, 2017, 08:51:41 AM »
So we had a young chap sent off for trying to break up a fight.
The match was recorded. The video clearly shows the B&S no.8 as the protagonist.
Our fullback goes to pull him off of our captain who he is punching on the floor in the act of grabbing this guys jersey the referee reports that our player made contact with the 8s head and sends them both off.
On review of the footage there is clearly no contact with the 8s head and no reaction from him or his team or management.
This was shown to the panel and refered to as inadmissible by them.
Making contact with the head is a mid level entry offence with an 8 week ban.
We were encouraged to plead guilty and the minimum ban for a guy with no previous is a 4 week ban.
This is ridiculous for a player who clearly did nothing.
Secondly we may have a promotion play off from Nat 3 to Nat 2 and this chap will not be available for the game which is a further blow as he has played all year.

I cannot understand the drive behind what I am sure sometimes is a thankless task of the disciplinary panel, but when presented with clearly supporting information not to act on it and impose the guilty verdict is just stupid.

Comments please?

Even by your account, he didn't do nothing, he did something.
And without being able to see the footage it's beyond anyone else to comment.

I'll comment.

We have sent video evidence to a hearing before, clearing showing that there was no case to answer - and we're told that it was inadmissible. So whilst I don't know the details of your case, I can fully understand your frustration.

Nobody wants to undermine the referee but a video camera doesn't make human mistakes!!!

That's another matter then. Why is film inadmissible?

I would have thought that the Chairman of the Disciplinary Hearing who made the decision that some evidence was not admissible should have been expected to justify his decision.

Kronos - did anyone ask him why the video could not be taken into account?

The only way I can imagine it being declared inadmissible is that there is some sort of due process that has to be followed in advance of a hearing for it to become admissible, that wasn't followed.

I think that may have been the issue in our case..... Something about informing them that video will be brought.

Might 19.10.8 of Reg 19 be the reason??

lancashire isn't it.
Especially when appendix 7 contains this:

"2. IF THE PLAYER ACCEPTS THE CHARGE
•   The Player should be asked to talk through the incident.
During this time, he/she may be asked to talk through the video footage (if available)"
•   The Player will then be asked to put forward any mitigation (Regulation 19.11.5)
